George bought a flat. His daughter Rose lives with her husband Paul in a nearby house. The house was registered in the names of Paul and Rose as joint tenants. George often went to their house for meals and they helped him with jobs around the flat. George’s health began to deteriorate and he sold his flat and moved into the house with Paul and Rose. George gave Paul the proceeds of sale of the flat and Paul used part of the money to build an extension of the house for George’s occupation and part of it to redeem the mortgage on the house. Rose died and Paul has told George to leave the house and to find somewhere else to live.
- Advise the George as to whether he will be evicted. (35 marks)
- Would your answer be any different if the house was conveyed in the names of Paul and Rose as tenants-in-common and it transpired that Rose had named George as her sole beneficiary to the property in her will? (5 marks)
