This coursework is in three parts as follows. Answer all three parts.
1 In Donoghue v Stevenson (1932) the House of Lords established a new framework for the law of negligence, adding that “the categories of negligence are never closed”. Examine the scope of the modern law, and in particular show how the law has moved away from strict liability in favour of a “reasonable standard of care”.
2 The cases of Factortame [1991] 1 AC 603 and The Nagasaki Spirit [1997] 1 Lloyds Rep 323 are examples of situations where English common law has had to deal with, respectively, EU law and International Salvage law. ?Give an account of both cases and show how national and international law interact.
3 Within the English law of contract, explain how the common law and statute together have defined the scope of exemption clauses.
