You are required to thoroughly investigate the meaning of the term “Repair” in the context of lease covenants and dilapidations. With full reference to case law and the leases provided*, you should explain how the scope of repair obligations can vary from lease to lease. After examining covenants which relate to the dilapidations process in the leases provided, you are also asked to advise a hypothetical client on how these may impact upon a dilapidations claim in each case (i.e. for each lease). The client could be either the landlord or the tenant, but you must make clear within your submission which you are advising. Note: It is important that your research is thorough and you clearly articulate the points you make. It will then be important to explain how the advice given to a client may change due to the physical application of these various covenants. It is also important that your answer makes full reference to case law and legislation/guidance where relevant.
